International Limited Warranty

Neo Forza provides International Limited Warranty and its consequent direct RMA servicing to the End User only under the following conditions :

  1. product is genuine;
  2. product is purchased from an authorized reseller or/and portal as a standalone item in its retail packaging; and not pre-installed in a system. For pre-installed products, End User shall need to seek the system reseller as such products are deemed unique; built to system specifications per se;
  3. product operates, as specified by its datasheet, in the operating environment for which it was intended, for a specific length of time from the date of purchase, determined by valid proof of purchase;
  4. End User has exhausted all efforts to seek servicing from authorized reseller or/and portal and to no avail and thus is turning to Neo Forza, in which case End User expressly agrees that the defective product will be first sent to Neo Forza in Taiwan for (i) evaluation, at (ii) End User’s own expense, and (iii) which such process can be time-consuming;
  5. product warranty periods vary and are listed in this section. In the event any of these warranty periods differ for the same product, the longest specified warranty period will apply;
  6. this warranty is limited to the original purchaser and is non-transferable. It provides End User resolute recourse to servicing the product directly with Neo Forza in the event that servicing by authorized reseller or/and portal is untenable.
No Neo Forza staff, authorized reseller, dealer, system builder or other agent is authorized to make any modifications, extension, or addition to this Limited International Warranty. Neo Forza does not and will not recognize such modifications, extensions or additions either locally or regionally, verbal or in-writ.

Exclusions

Nevertheless meeting the above conditions, this International Limited Warranty does not cover problems or damage resulting from, but not limited to, any of the following:

  1. Wear and tear associated with normal use;
  2. Damage caused to the product(s) by End User or any non-authorized third-party;
  3. Damage caused by acts of nature, abnormal mechanical or environmental condition, modification, abuse, accident, disassembly, misapplication, neglect, or abnormal use conditions;
  4. Tampering with the serial number or identification label(s) or sticker(s), whether removed, damaged, altered, or made illegible;
  5. Damage caused by improper assembly, handling, installation, or operation; including any use not in accordance with any supplied product instructions;
  6. Damage caused by any external electrical fault or by connection to an improper voltage supply or by electrostatic discharge (ESD);
  7. Tampering of parts of the product;
  8. Missing, damaged, detached, eroded, or bent contact pins, chips, parts;
  9. SSD failure due to misuse or End User damage. This includes using Neo forza SSD for mining/farming operations where rapid increases in data writes to the host causes abnormal drops in SSD speeds or wear damage;
  10. Any other cause not related to a product defect in materials or workmanship.

Valid Proof of Purchase

A valid proof of purchase shall strictly be defined as any of the following:

  1. A dated sales receipt from an authorized retailer or reseller. The sales receipt must show the product description and price on its own.
  2. A dated official e-mail from an authorized retailer or reseller confirming purchase and shipment of the product. The confirmation email must show the product description and price on its own.

Ambiguous examples of non-valid proof of purchase:

  1. Receipts from non-authorized local/regional reseller, retailers, or dealers.
  2. Receipts from any online auction websites, liquidators, or clearance houses.
  3. Receipts of refurbished products not certified by Neo Forza.
  4. Receipts of re-used or pre-owned products.
The above non-valid proof of purchases contravenes the condition of purchasing from authorized-reseller or/and contravenes the condition of non-transferability. In such cases International Limited Warranty shall be inapplicable and End User is advised to seek servicing from whence purchased.

*Local laws may have different definition to (Limited) Lifetime Warranty under which such definition shall apply.

Unless prohibited by local applicable law, any implied warranty or condition of merchantability or fit-for-purpose on the product is limited in duration to the duration of the applicable limited warranty period for your product.

Obligation

Neo Forza’s obligation for any breach of warranty shall be to repair or replace any part of its products proven defective due to improper workmanship or materials only. Any replacements provided shall be the same as product model or equivalent. Shipping and handling charges, as well as any applicable tariffs, duties, taxes, or other fees, except where prohibited by applicable local law, shall be End User’s obligation.
Any repaired or replacement hardware will be warranted for the remainder of the original warranty period, or thirty (30) days, whichever is greater, or for any additional period of time that is specified by law in End User’s local jurisdiction.

Disclaimer

Neo Forza shall not be liable for, and does not cover under warranty: recovery of data; installation of Neo Forza products; inspection or testing costs; installation and removal fees; and general, special, incidental, or consequential damages which include, but not limited to, loss of data, revenue, or profit (whether direct or indirect), or commercial loss for breach of any express or implied warranty on your product even if Neo Forza has been advised previously of the possibility of such damages. Some local laws do not allow the exclusion or limitation of special, indirect, incidental, or consequential damages, so this limitation may not apply in your jurisdiction.

Statutory Consumer Right

End User may have legal rights under applicable local legislation governing the sale of consumer goods. Such rights shall not be affected by the warranties in this International Limited Warranty
